Where a Carlsbad retaining wall is part of an approved grading plan, no separate building permit is issued for it. The wall is reviewed with the civil engineer and Land Development Engineering instead, and inspected by the Construction Management and Inspection division rather than by Building. So the same wall reaches the city through one door or the other depending on whether it arrived with a grading plan attached.
NOTE: When retaining walls are part of an approved grading plan, a separate building permit will NOT be issued.

The city gives its reason for the four feet rather than leaving it as a number: soils conditions vary across Carlsbad. The exemption also falls away where the wall impounds Class I, II or IIIA liquids.

A pool fence in California stands at least sixty inches high. No more than two inches may be left between the ground and the bottom of it, and no gap in it may pass a four inch ball. The outside face has no handholds or footholds a child under five could climb. Gates open away from the pool and close and latch by themselves, with the latch set no lower than sixty inches above the ground.

A Carlsbad wall is inspected four times: at the excavated footing with steel tied in place, at the reinforcement before grouting, after grouting once the drain system is in, and at the end after backfill and fine grading. Grout goes in as a continuous pour in lifts of no more than six feet, and cleanout holes are required for any pour over five feet. Without cleanouts, the block cannot be laid higher than the grout pour and each pour takes its own inspection.
Note that cleanouts are required for all grout pours in excess of five feet.

California writes no clear view triangle into state law. The Streets and Highways Code counts a fence as an encroachment once it stands in, under or over any part of a state highway right of way. Section 670 then makes putting one there without a written permit from the department a misdemeanor. That covers the public strip, not the corner of a private yard. Government Code section 65850 gives every city and county the power to set the height and place of structures, and that is where a corner triangle gets written in California.

Carlsbad defines a surcharge geometrically. It is any load in addition to level grade sitting inside the area described by a 45 degree angle drawn from the bottom of the footing up to level grade. The handout then names examples, and a fence is among them, alongside a building, a driveway and a slope. A retaining wall carrying a surcharge needs a permit at any height, so a fence inside that wedge removes the exemption from the wall beneath it.
A “surcharge” on a retaining wall is any load in addition to level grade, within that area defined by a 45 degree angle from the bottom of the footing to level grade.

What this page does not cover
A city ordinance is not the only rule that reaches a fence. The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone. A homeowner association can be stricter than the city and nothing in the municipal code will say so. None of those appear here.
