Where a service station adjoins property in any residential district, or is separated from it only by a public alley, a masonry wall of six feet has to be erected and maintained along the common lot line or along the alley lot line. The same sentence is repeated for the other listed automotive uses. So the ordinance does not merely allow a wall on the boundary, it puts one there. Every such masonry wall then has to be protected by a fixed curb or barrier to keep vehicles from striking it, which is a practical detail most codes leave to a site plan. A required screening wall or fence generally sits either on the property line or wherever the Director of Planning and Development Services approves. The legal responsibility for installing and maintaining the wall in good repair rests with the owner of the property, whether the work is actually carried out by the owner, the occupier or somebody else. Nothing states which side the finished face points toward, and nothing divides the cost.

How tall can a fence be in Albany?

Albany states no maximum fence height. The screening section sets a floor instead, requiring a protective wall or fence of at least six feet where a listed commercial or industrial use abuts or faces across an alley a residential, office or certain commercial districts. The pool section sets another floor at four feet. Nothing anywhere in Title III caps how tall an ordinary residential fence may be, so the limits that actually bite are the corner visibility band and whatever the Building Code requires for construction. That is unusual: most cities write a ceiling first and a floor only for pools. The screening requirement applies on new construction and again when an existing building changes to one of the listed uses, so a change of tenant can trigger a fence that was never needed before.

Such walls and fences shall be a minimum of six (6) feet in height, constructed in compliance with the Building Code and, unless otherwise indicated, located either on the property line or in a location approved by the Director of Planning and Development Services.

Every swimming pool in Albany has to be enclosed by a fence of at least four feet, and the section then does something unusual: it sends that fence to the corner visibility rule by name. The fencing has to be located so that it does not obstruct visibility at road intersections and has to comply with all the requirements about visibility in Section 1.11. Most cities treat a pool fence as a safety requirement and leave the corner to a separate part of the code, so a pool fence ends up satisfying one rule and breaking the other. Albany joins them. A pool house is separately made to follow the accessory building rules, which keep it out of a front yard, ten feet from the principal building and five feet from the rear and interior side lot lines. The ordinance names no permit for an ordinary fence.

Fencing. All swimming pools shall be enclosed by a fence that is at least four (4) feet in height. The fencing shall be located in such a manner that it does not obstruct visibility at road intersections.

How fence height is measured in Albany

Albany does not set this. It leaves it to each Georgia county and municipality, through the zoning ordinance it adopts.

Georgia never says where a fence height is measured from. The Zoning Procedures Law defines a zoning ordinance as the local rule that sets the uses and development standards of property, and a fence height with its starting point is one of those standards. The state minimum standard codes chapter never uses the word fence, so the building side of state law does not pick the question up either. That leaves how a fence is measured, whether from natural grade or finished grade and what happens when a fence sits on a retaining wall, to the county or city ordinance that sets the number.

"Zoning ordinance" means an ordinance or resolution of a local government establishing procedures and zones or districts within its respective territorial boundaries which regulate the uses and development standards of property within such zones or districts.

Fence rules for corner lots in Albany

In all districts, no fence, wall, shrubbery, sign, marquee or any other obstruction to vision is permitted between three and a half feet and fifteen feet above street level within twenty feet of the intersection of the right-of-way lines of two streets or railroads, or of a street and a railroad right-of-way line. Fifteen feet is the tallest ceiling in this set by a wide margin and it means a tree canopy has to be lifted well clear rather than merely trimmed, since the protected band extends higher than a low roof. Naming railroads alongside streets is also rare, and it puts the same restriction at a level crossing as at a corner. Twenty feet is measured from the meeting of the right-of-way lines rather than from the curb, and because the ordinance sets no fence height limit at all, this band is the only thing that stops a tall fence at a corner.

In all districts, except as otherwise noted, no fence, wall, shrubbery, sign, marquee or any other obstruction to vision between the heights or three and one-half (3 1/2) feet and fifteen (15) feet above street level shall be permitted within twenty (20) feet of the intersection of the right-of-way lines of two streets or railroads, or of a street and a railroad right-of-way line.

Where the ordinance requires a screening wall or fence it also names what it may be built from. The list runs clear heart redwood, heart cypress, red cedar or pressure treated Southern Yellow Pine at a stated retention, or another suitable outdoor material with the appearance of wood; brick, stone or similar, which is required for walls in the two manufacturing districts; and hard-coat stucco or tabby. Naming tabby, a shell and lime concrete used along the Georgia coast, is a local touch few codes carry. Chain link is permitted in front yards and in yards next to a street only in the manufacturing districts. Any other required fence has to be at least eighty percent opaque with openings no wider than two and a half inches, which is a screening test rather than a materials one. None of this reaches an ordinary residential fence, which the ordinance leaves unregulated as to material.

Georgia writes a hard fence spec for one kind of farm. A licensed deer farm has to ring the part of the site holding farmed deer with a fence at least eight feet tall. The bottom six feet is woven mesh, in a design, strength, gauge and mesh the Department of Agriculture approves. Wire added on top to reach eight feet may be smooth, barbed or woven, with strands no more than six inches apart. Trees and structures that could fall and break the fence have to come out.

What this page does not cover

A city ordinance is not the only rule that reaches a fence. The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone. A homeowner association can be stricter than the city and nothing in the municipal code will say so. None of those appear here.
