The state residential code covers construction and says nothing about who pays for a fence on a line, and the state pool rules do not reach it. The fence paragraph in each zone is written entirely about height and about which required yard the fence stands in, and the only other rule that reaches a boundary is the corner one. So a fence may sit on the line in Augusta, and everything two neighbors might disagree about afterwards falls outside the zoning ordinance. How tall can a fence be in Augusta?

Augusta answers this, but the answer changes depending on which yard the fence stands in.

Augusta states the same two figures in every residential zone and repeats them in the office and commercial zones as well. A fence, latticework screen or wall in a required side or rear yard may not exceed six feet, and one in a required front yard is limited to four. Latticework is named alongside a solid fence so an open screen gets no extra allowance, and a wall is measured by the same numbers as a fence. The paragraph then points at the corner rule rather than repeating it, saying any fence, wall or landscape feature at the corner of intersecting streets described in Section 3-6 is subject to the additional restrictions in that subsection. Some industrial and commercial uses carry their own floor instead of a ceiling: an automobile body and fender shop has to enclose its work and vehicle storage on all sides behind a solid wall or finished fence of not less than six feet.

Fence, walls. A fence, latticework screen or wall in a required side or rear yard shall not exceed six (6) feet in height. A fence, latticework screen or wall located in a required front yard shall be limited to four (4) feet in height.

Do I need a permit for a fence in Augusta?

An ordinary fence in Augusta does not appear in a permit list anywhere in the zoning ordinance. A junk yard fence does, and it comes with deadlines. Every owner or operator of an automobile salvage yard, used parts lot or other junk yard legally existing under approved zoning had to register with the License and Inspection Department and pay a regulatory fee within thirty days, filing dimensions and acreage, a detailed drawing of land use with an estimated vehicle capacity and the entry and exit points, and a containment station plan. Compliance then runs on a graduated schedule counted from the date of plan approval rather than all at once. A new salvage yard has to sit on ten acres or more, measured as the active area after setbacks, and nothing may sit within fifty feet of a stream. Failing to register within the thirty days is itself a violation.

All owners, operators, or maintainers of automobile salvage yards, used parts lot or other junk yards legally existing under approved zoning status at the effective date of this Ordinance shall register and pay a Regulatory Fee with Augusta License & Inspection Department within a period of 30 days from the effective date of this Ordinance.

How fence height is measured in Augusta

Augusta does not set this. It leaves it to each Georgia county and municipality, through the zoning ordinance it adopts.

Georgia never says where a fence height is measured from. The Zoning Procedures Law defines a zoning ordinance as the local rule that sets the uses and development standards of property, and a fence height with its starting point is one of those standards. The state minimum standard codes chapter never uses the word fence, so the building side of state law does not pick the question up either. That leaves how a fence is measured, whether from natural grade or finished grade and what happens when a fence sits on a retaining wall, to the county or city ordinance that sets the number.

Fence rules for corner lots in Augusta

Augusta writes its corner rule with a condition most cities leave out. In all zones except the general business and the two industrial zones, nothing over three feet may obstruct a clear view at the corner of intersecting streets, but only where either or both of those streets is less than sixty feet in width. On a corner where both streets are sixty feet or wider the rule does not apply at all and the six foot allowance runs to the boundary. Where it does apply the area is large: the triangle has its apex at the intersection of the center lines of the traveled roadways, with legs sixty feet long measured along those center lines. Measuring from the center line rather than from the property line pushes the restricted area well onto the lot. Utility poles, lighting standards, post office boxes and traffic signs are exempt, and so is a tree whose branches are kept trimmed to eight feet above the ground.

Nothing in the Augusta zoning ordinance names what a fence may be built from. Barbed wire, razor wire, electric fencing and chain link are not mentioned in it at all, so an ordinary fence is governed only by its height and its position. The one place a material is specified sits in the nuisance title rather than in zoning, and it applies to auto salvage yards, used parts lots and junk yards. Those have to screen the site in one of two ways: green mesh nylon shade cloth securely attached to a six foot cyclone fence, or a six foot wood board privacy fence with no color alteration, maintained on a continuous basis. Naming the color rule is unusual and it means the fence cannot be painted or stained. A third requirement runs alongside both, sending the site to the street yard requirements of the county tree ordinance.

Georgia writes a hard fence spec for one kind of farm. A licensed deer farm has to ring the part of the site holding farmed deer with a fence at least eight feet tall. The bottom six feet is woven mesh, in a design, strength, gauge and mesh the Department of Agriculture approves. Wire added on top to reach eight feet may be smooth, barbed or woven, with strands no more than six inches apart. Trees and structures that could fall and break the fence have to come out.

The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone.
