Waterloo sets no setback from a neighbor and one flat condition instead: no portion of a fence may extend onto adjacent property or right-of-way, except as approved by an encroachment agreement. Naming the agreement matters, because it means a fence that does cross the line is not simply illegal but can be regularized by consent with the city. The rule applies to landscape features such as sculptures and walls as well as to fences. Where distance does appear it is buying height rather than keeping neighbors apart. A fence parallel to and within three feet of a side lot line may exceed four feet in a front yard where the building on the abutting lot extends past the established front yard of this one, which lets a fence match a neighbor who already built forward, and the whole allowance stops at eight feet.

Waterloo allows eight feet in a residential side or rear yard, which is two feet above what most cities give, and four feet in a front yard. The corner lot rules then split by how the house is addressed. On a corner lot addressed and facing the narrow street frontage, eight feet is allowed in the rear yard and along the street side adjoining it, running from the center point of the house out to the street lot line and back. On a corner lot addressed or facing the longer frontage, that eight feet has to keep the same setback the house keeps from the street, and anything closer to the street than the house stays at four feet, unless the rear yard abuts the rear yard of another corner lot. A non-residential fence outside the residential districts stops at eight feet, rising to ten if everything above eight is chain link or wire.

On interior lots, no such fence shall exceed eight (8) feet in height in the side or rear yard and four (4) feet in height in the front yard.

Waterloo splits the difference on the retaining wall question in a way no other city in this project does. A wall extending above grade is regulated as a fence. A retaining wall is not regulated by the fence rules at all, except that where a wall or fence is built on top of one, or within three feet of the top of one, the maximum height of that fence has to include one half the height of the retaining wall. So a six foot retaining wall costs three feet of the eight allowed above it. Between Portsmouth in Virginia, which adds the whole wall, and Portland and Bend in Oregon, which add none of it, Waterloo counts half. The half need not be included at all where the height of the fence does not exceed the maximum allowed above the original natural grade of the spot, so the rule only bites where the wall actually raised the ground.

Waterloo runs two corner rules with two different shapes. On a corner lot in a residential district, nothing may be erected, placed, planted or allowed to grow so as materially to impede vision between two and a half feet and ten feet above the centerline grades of the intersecting streets, inside a triangle drawn from the lot lines with legs of twenty feet. The fence section adds a second area for the place a driveway meets a street: no solid fence may materially impede vision between two and a half feet and eight feet above the centerline grades inside a triangle bounded by the street at the back of curb, the driveway or alley, and a line between two points twenty five feet from where they meet. So the driveway triangle is larger than the street corner one, and its protected band stops two feet lower, and only a solid fence is caught there where anything at all is caught at the street corner.

Iowa adopts the 2024 International Residential Code for houses, duplexes and townhouses up to three stories and the structures beside them, then lists the changes it makes. None of those changes touch a wall that holds back earth, so the model code carries that rule unchanged. Iowa does delete sections R103 through R114, which is where the model code keeps the permit chapter and the list of work that needs no permit. So the foundation and retaining wall chapter stays in force while the permit call belongs to the city or county.

Fence materials allowed in Waterloo

Waterloo answers this, but the answer changes depending on whether the fence is residential and how high the wire sits.

Waterloo handles wire by height rather than by ban. On a non-residential fence outside the residential districts, barbed wire, concertina wire and similar wire may not sit closer than six feet to the ground, with one exception for a fence used purely for agricultural purposes. Below six feet it is out; above six feet it is in. The same sentence bars salvaged material outright on those fences. On the residential side the code names no permitted material and no prohibited one, and regulates by height and position instead, so a residential fence in Waterloo may be built of whatever the owner chooses provided it keeps within eight feet and stays off the neighbor. The definitions chapter repeats the salvage and wire rules inside the definition of a non-residential fence itself, which is unusual drafting: the prohibition is part of what the word means rather than a separate rule.

What this page does not cover

A city ordinance is not the only rule that reaches a fence. The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone. A homeowner association can be stricter than the city and nothing in the municipal code will say so. None of those appear here.
