Fences and retaining walls are not subject to accessory structure setback requirements, so neither has to keep any distance from a lot line and both may stand on the boundary. The proof is in the next section along, which lists what counts as an accessory building or structure for setback purposes and expressly excludes fences and retaining walls from that list, alongside air conditioners, emergency generators, flagpoles, heat pumps, signs and wireless facilities. The retaining wall row of the fence table then assumes a wall sitting along a lot line and states how it is measured. The only distance the fence rules state anywhere is horizontal and belongs to the corner: twenty five feet from where the street lines meet.

In the residential zones a fence may not exceed four feet in the front yard and eight feet in the side or rear yard, and the two exceptions to the front yard figure both turn on the street rather than on the lot. Where the abutting street is classified as an arterial highway or greater, the front yard fence may be six feet, which is the code accepting that a house facing a big road needs a real barrier. Where the abutting right-of-way is unimproved, six feet is allowed too, and if the right-of-way is later improved an existing taller fence becomes nonconforming and may be kept and repaired but has to comply when replaced. The RHD and mixed use zones read four feet out front and eight behind. Industrial zones read four out front, with the Approving Authority able to allow eight through site plan review. A public school may have six feet in its front yard. Deer mesh may be eight feet in any yard of a residential property.

There is no discretion beyond that finding, no fee stated in the section and no height threshold, so a two foot fence needs the same permit as an eight foot one. The single exception is deer mesh, which needs no permit at all, and which the fence table separately allows at eight feet in any residential yard. Two other approvals can reach a fence. The Approving Authority may allow a front yard fence up to eight feet in the I-L and I-H zones as part of a site plan review. And a Planned Development zone carries its own additional fence rules in Section 25.7.4.3(d).

The retaining wall row of the fence table is where Rockville does its measuring, and it splits the question by purpose rather than by shape. A retaining wall along a lot line that is holding back a mass of earth or other material may be any necessary height, measured from the lower ground level, so the engineering need sets the size and nobody is asked to justify it against a fence limit. But if that same wall is also intended to act as a fence for the property at the upper grade, the fence height rules of the zone apply to it. So the test is what the wall is for, and a wall that does both jobs is measured as a fence. The corner rule supplies the only other datum, reading four feet above curb level. Nothing states what an ordinary fence on level ground is measured from, and a berm is not addressed.
Where a retaining wall intended to hold back a mass of earth or other material is located along a lot line, it may be of any necessary height measured from the lower ground level. If the retaining wall is also intended to act as a fence for the property at the upper grade level, the fence height requirements of the zone apply.

On a corner lot a fence may not exceed four feet above the curb level for twenty five feet from where the street lines meet. Two things about that are worth pulling out. The datum is the curb rather than the ground the fence stands on, so a yard that sits above the road gets less fence than one at street level. And the twenty five feet is stated as a distance from the intersection rather than as a triangle with two legs, which reads as a quarter circle in plain language even though a reviewer will almost certainly apply it as a triangle. The rule sits as an exception to the eight foot side and rear yard allowance, which is where it does its work, because the side yard of a corner lot faces a street. Retaining walls made necessary by changes in street grade, width or alignment are expressly released from it.

Barbed wire does not appear in the fence section. Razor wire does not appear. An electric fence does not appear. There is no rule that the finished side has to face outward. What the phrase standard or typical does is leave the judgment with the Chief of Zoning, who has to find a proposed fence consistent with the chapter before issuing the permit, so an unusual material is settled at the counter rather than by reading the code. The one material the ordinance does name anywhere near a fence is deer mesh, and it names it to grant two exemptions, letting it reach eight feet in any residential yard and go up without a permit.

The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone.
