Livonia protects a twenty five foot triangle drawn between the street right of way lines and holds everything inside it to thirty inches, measured from the top of the curb at street level or from the established street grade where there is no curb, and the answer turns on whether the obstruction is a tree and how high its branches start. Retaining walls
A retaining wall in Michigan needs no building permit if it is four feet tall or less, measured from the bottom of the footing up to the top of the wall. Livonia gives two neighbors a veto and puts the posts on the builder side of the fence. A privacy fence may not stand within or abutting property in a residential district unless the adjoining owner consents in writing, and it is then erected on the lot line itself, with only one fence allowed to separate two properties. Separately, no fence may be built in the side yard of a residential lot that has an adjacent or abutting driveway without the written consent of the owner of that driveway. Supporting posts, cross members and protruding bolts, screws and hardware go inside the lot and face the interior of the builder property, except that the posts of a privacy fence may be centered within the panels, which is the board on board construction the ordinance calls good both sides. Border planting along a side lot line in front of the building line is held to thirty inches and has to stay eighteen inches off the line.

No fence shall be constructed in the side yard of a residential lot which has an adjacent or abutting driveway, without the written consent of the owner of the abutting driveway.

A Livonia fence that encloses property or stands in a required side or rear yard may be neither sight obscuring nor more than four feet high, which rules out the ordinary six foot board fence unless it qualifies as a privacy fence. A privacy fence, meaning a decorative partition fence designed to obscure sight, may reach six feet four inches, and a privacy screen around a patio, deck, courtyard or pool may reach six feet six. Nothing may be built in a front yard, or nearer the front than the front building line of the house or the minimum required front yard, whichever gives the greater setback. On a corner lot a fence may enter the corner side yard at up to six feet only if it clears four conditions together, including a police department view that it will not block a driver line of sight and a determination by the Director of Inspection that its type, height, color and materials conform to adjoining fences and to neighborhood standards.

Fences which enclose property or are within the required side or rear yard shall not be sight-obscuring or exceed four (4) feet in height, measured from the surface of the ground, except for privacy fences as provided for elsewhere in this section.

Livonia requires a permit from the Inspection Department to erect, re-erect, alter, relocate or make a major repair on any fence or privacy screen, with major repair defined as work on the structural part and minor repair, such as painting or staining, exempt. The owner is responsible for getting it unless a contractor has been hired, in which case the contractor is, and on a violation either or both may be prosecuted. The application is unusually demanding. It carries plans and specifications, and a plot plan showing the property lines, the buildings, the position of the fence relative to adjoining streets, houses and driveways, and the precise location of the fence posts against the lot lines, with the posts on the inside of the fence or centered unless the adjoining owners have agreed otherwise in writing. It also carries the adjoining owner written consent for a privacy fence, and either a written agreement with the neighbor about where the lot line is or a survey showing it.

Michigan puts no pool fence height in its own statute. The state construction code act builds the Michigan code out of the national model codes, including the International Residential Code, plus whatever changes the director makes. So the fence rule for a pool at a house comes from that model code. The same act says a Michigan version of a code has to be free to the public before anyone can enforce it.

Michigan has no spite fence law. The state fence act covers who pays, who the fence viewer is, and what a fence viewer can decide, and section 43.55 says plainly that a fence viewer does not settle boundary arguments. Nothing in the act turns on why a fence went up or how tall it is. A claim about a fence built to annoy rests on ordinary nuisance law made by judges, and on city zoning.

Livonia answers this, but the answer changes depending on whether the fence is a privacy fence or screen.

Livonia measures from the surface of the ground to the highest point of the fence or of the supporting structure, so a post or a cap standing above the panels counts, which is the opposite of the cities that measure to the top of the boards. It then adds a requirement that explains the odd precision of its figures: the panels of a privacy fence have to sit two inches off the ground, and a privacy screen the same. Those two inches are for air and drainage rather than for looks, and they are why the privacy fence limit is six feet four rather than six feet. The ground itself supplies the datum along the whole run, so a fence on sloping land is read where it stands rather than from an averaged or a chosen point.

The panels of the privacy fence must be two (2) inches off the ground and shall not exceed six (6) feet, four (4) inches in height, measured from the surface of the ground to the highest point of the fence or the supporting structure.

Livonia protects a twenty five foot triangle drawn between the street right of way lines and holds everything inside it to thirty inches, measured from the top of the curb at street level or from the established street grade where there is no curb. The rule names fences, walls, landscaping, plantings, shrubbery and any other obstruction to vision, so it does not depend on what the thing is. One exception exists and it is for trees: a shade tree is permitted where all its branches are at least six feet above street grade. A second visibility rule runs alongside it and applies everywhere rather than at corners, saying no fence, hedge or landscape material may materially obstruct the vision of motorists crossing a public sidewalk or entering a street from an adjacent driveway.

A retaining wall in Michigan needs no building permit if it is four feet tall or less, measured from the bottom of the footing up to the top of the wall. The footing sits below the ground, so the four feet starts lower than the yard does. Michigan writes this itself. Rule 505 replaces section R105.2 of the residential code. A wall holding up a surcharge needs a permit at any height. A surcharge means extra weight pressing on the soil behind the wall, such as a driveway or a building. Skipping the permit does not make legal any work that breaks the code or a city rule.

Livonia requires a fence to be built of new material only, unless the Inspection Department has examined the other material and found it sound, usable and suitable for fencing. Two specific things are then barred by name: plastic or other strips intertwined in chain link or woven wire, and fences made of opaque fiberglass panels. Barbed wire may not be constructed or maintained between or abutting residential properties, along a street or in front of a public place, though a manufacturing plant that does not abut housing, or a public utility installation in any district, may run stranded barbed wire on arms or cradles leaning inward over its own side at least six feet above grade. Coils of barbed wire, concertina wire and razor wire are prohibited in every district. Sharp or pointed tops, broken glass, spikes and projecting nails are all out, and a gate may not swing into a position where it presents a pointed member. Electrified fences are prohibited unless they are below ground.

Plastic or other type of strips intertwined in chain link or other kinds of woven wire fencing shall be prohibited, as well as fences constructed of opaque fiberglass panels.

What this page does not cover

The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone.
