A fence in a utility easement needs written authorization from the easement holder or the city, and the city takes no responsibility for damage, repair or replacement when one has to come out. Nothing may block natural drainage, block the view of or access to a fire hydrant, or block a window or a door. The finished side faces outward, and every segment along one side of a lot matches in style and color.

Fences and Walls shall not be located within two feet of a sidewalk.

Apopka prints one table across five district groups. A residential or commercial lot gets four feet in the front yard and in a rear yard facing a street, six feet in an interior rear or side yard. Industrial land gets six in front and eight elsewhere, the mixed use districts follow the residential figures, and the institutional, park and airport districts get six throughout. A residential or commercial front yard fence rises to eight feet where it runs along a common line with an industrial district. A rear wall over six feet may be approved by the development review committee if it is internal, out of sight of any right of way, heavily screened, poured in place or tilt wall and under fifteen feet. Anything over eight feet goes through development plan review.

Any fence or wall taller than eight shall be approved as part of the review of a development plan.

Apopka reviews a fence at whichever comes first of planned development, development plan, plat or building permit, and the fence itself needs the proper permits and has to be built to the proposed finished grade elevation. Anything taller than the table allows, or any barbed, razor or electric wire, goes through a security exemption plan, which the Director may approve only on two findings: that the condition, location, use or history of activity puts the land in significantly greater danger of theft or damage than its surroundings, and that the fence will not significantly harm the security, functioning, appearance or value of the land around it. Failing either one, the plan is denied.

Florida has no spite fence law. The fence chapter sets no height that sets anything off and no rule about why a fence went up. Chapter 823, the public nuisance chapter, runs from bonfires to abandoned boats and never reaches a fence built to annoy a neighbor. A claim in Florida rests on common law nuisance instead, which is judge made rather than written by the legislature.

Florida answers the measuring question outright in its oldest fence section. A general fence stands at least five feet and keeps its gaps under four inches for the first two feet up from the ground. Where the fence is built with a trench beside it, those five feet run from the bottom of the ditch to the top of the fence. A bottom point and a top point, both named, which is the part most state fence rules leave out. The rule is about holding livestock. A yard fence in a Florida city is sized by local land development rules adopted under section 163.3202, and those rules carry their own way of measuring.

It has to be supported by a professional engineering report giving the full structural design, covering structural, geotechnical and civil engineering, and it has to carry an engineered safety railing on top. Six feet is the ceiling for any retaining wall. Access and maintenance easements are required both above and below every one of them, at least five feet wide and no steeper than ten to one, so the wall can still be reached from either side once the land around it is built on.

All retaining walls over 30 inches in height shall be supported by a professional engineering report that provides full structural design of the wall including structural engineering, geotechnical engineering, and civil engineering. Retaining walls over 30 inches in height shall have safety railings engineered on top of the walls. Retaining walls shall be a maximum of six feet in height.

What this page does not cover

A city ordinance is not the only rule that reaches a fence. The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone. A homeowner association can be stricter than the city and nothing in the municipal code will say so. None of those appear here.
