Who owns the fence between two properties in Florida?

Florida has no partition fence statute. Chapter 588 is about legal fences and livestock, and every section in it deals with fence strength, posted land, and impounding animals rather than with two neighbors splitting a cost. Chapter 704, which covers easements and rights of entry, is also silent on a boundary fence. Cost sharing in Florida is a matter of private agreement.

How tall can a fence be in Florida?

Florida sets no statewide limit on residential fence height. The only height in the fence chapter is the five foot minimum that makes a fence a legal fence for holding livestock, which is a floor for farm land and not a ceiling for a yard. The permit statute names no height either. Height is set by municipal and county ordinance.

Florida runs one statewide building code and makes a permit the default for building work. The statute itself carries no fence line. It does force a local government to waive the permit for work on a single family home valued under $7,500, and the fence exemption by height lives in the Florida Building Code rather than in the statute.

Pool fence requirements in Florida

The Residential Swimming Pool Safety Act sets a barrier of at least four feet, measured on the outside. The same section bars gaps or footholds that let a small child get under, through or over the barrier, and it requires the barrier to sit around the pool itself and to be separate from a yard fence unless that fence is on the pool perimeter and meets the same rules. Gates have to swing away from the pool and latch themselves.

Florida has no spite fence statute. The fence chapter sets no height trigger and no rule about intent. Chapter 823, the public nuisance chapter, runs from bonfires to derelict vessels and never reaches a fence built to annoy a neighbor. A claim in Florida rests on common law nuisance instead.
