Fence laws in Winter Haven, Florida, question by question
The short version
- Who pays on the line
- No fence, wall or hedge may be built or planted in a Winter Haven right of way, with one exception written in: something placed as part of a public highway safety or beautification project.
- How tall
- Winter Haven puts its limits in one table, and the answer turns on the zoning district, the yard, and what the land is actually used for. The figure is 4 feet, for fence or wall in a front yard.
- Permits
- Winter Haven requires a permit for a wall of any height and for a permanent fence over six feet, with the application showing the location against the property lines and easements and the height, and the structure designed to the wind speeds in the Florida Building Code, and the answer turns on whether the work is new, a repair, or temporary construction fencing. The figure is 6 feet, for fence height above which a permit is required.
- Pool barriers
- Florida requires a pool barrier at least four feet high, measured on the outside. The figure is 4 feet, for residential swimming pool barrier, measured on the outside.
- Spite fences
- Winter Haven has no spite fence statute. The chapters that were read are listed below. Cities and counties decide this one.
- Measured from what
- Winter Haven handles raised ground by regulating the berm itself rather than folding it into the fence height. The figure is 25 percent, for steepest slope allowed on a berm.
- Corner lots
- Florida has a state rule about blocking a driver from seeing what is coming, and it is written about signs. It reaches signs next to a state highway, an interstate or a federal aid primary road only.
- Retaining walls
- Winter Haven exempts a retaining wall from the height table but not from the rest of the section. The figure is 5 feet, for setback required for a retaining wall.
- Materials
- A Winter Haven fence has to be built of new materials made for the purpose, or of materials aged for proper architectural effect, which rules out salvage that simply looks old, and the answer turns on the district and what the fence is for. The figure is 3 strands, for barbed wire allowed in the industrial districts.
- Livestock
- Florida sets a legal fence at three feet high, made of barbed or other soft wire, with at least three strands pulled tight on posts, trees or other supports no more than twenty feet apart. The figure is 3 feet, for height of a legal fence.

No fence, wall or hedge may be built or planted in a Winter Haven right of way, with one exception written in: something placed as part of a public highway safety or beautification project. The finished side of a fence faces outward toward the adjoining property, a retaining wall and a subdivision screening wall each keep five feet back from the line, and no part of a screening wall may sit in an easement.
No fence, wall, or hedge shall be constructed or planted in any right-of-way, except as may be placed as part of a public highway safety or beautification project.

- no rule, documents checkedFlorida has no law about splitting the cost of a fence on a boundary. Chapter 588 is about legal fences and livestock, and every section in it deals with fence strength, posted land and impounding animals. Chapter 704, which covers easements and rights of entry, says nothing about a boundary fence either. In Florida the split is whatever the two neighbors agree to. Fla. Stat. ch. 588Florida · Statute
How tall can a fence be in Winter Haven?
Compare fence height across all 50 states
Winter Haven answers this, but the answer changes depending on the zoning district, the yard, and what the land is actually used for.
Winter Haven puts its limits in one table. The agricultural, estate, residential, mixed use and C-1 and C-2 districts get four feet in the front yard and six in the side and rear, and the front yard is defined as running from the front property line to the front building line of the house. The C-3, C-4 and industrial districts get eight feet in any yard, dropping back to six where the land is actually being used for housing. The public institutional, recreation and conservation districts have no limit at all. A subdivision screening wall may be six feet with columns to eight. Where a planned unit development is silent, the code assigns it the standards of a named district by use.
Fences or walls placed on property presently being utilized for residential purposes and located in the C-3, C-4, I-1, or I-2 zoning districts shall have a maximum fence height of six (6) feet in the front, rear, and side yards.
The answer turns on the zoning district, the yard, and what the land is actually used for.

- Four feet. 4 ft
- a residential, mixed use, C-1 or C-2 side or rear yard
- Six feet. 6 ft

- the PI, PR and CN districts

- no rule, documents checkedFlorida sets no statewide limit on how tall a fence at a house can be. The only height in the fence chapter is the five foot floor that makes a fence a legal fence for holding livestock, which is a minimum for farm land and not a cap for a yard. The permit statute names no height either. Height comes from city and county ordinance. Fla. Stat. ch. 588Florida · Statute
Do I need a permit for a fence in Winter Haven?

Winter Haven answers this, but the answer changes depending on whether the work is new, a repair, or temporary construction fencing.
Winter Haven requires a permit for a wall of any height and for a permanent fence over six feet, with the application showing the location against the property lines and easements and the height, and the structure designed to the wind speeds in the Florida Building Code. It then extends the requirement to repairs: any wall, any fence over six feet and any retaining wall needs a building permit to be repaired. Temporary security fencing may stand at a construction site while the permit is active and comes down before the certificate of occupancy. The Development Special Magistrate may grant a variance to the heights for the character of the neighborhood, the slope or terrain, architectural necessity, or a residential lot abutting a commercial establishment.
Repairs to all walls of any height, any fence over six (6) feet in height, and all retaining walls shall require a building permit.
The answer turns on whether the work is new, a repair, or temporary construction fencing.
- a new wall of any height, or a fence over six feet
- A permit, with a plan and wind load design. 6 ft
- a repair to a wall, a tall fence or a retaining wall
- A building permit as well.
- temporary construction fencing
- Allowed while the permit is active, removed before the certificate of occupancy.

Pool fence requirements in Winter Haven
Compare pool barriers across all 50 states
Florida answers this in its own law. The words that do it are quoted below.
Florida requires a pool barrier at least four feet high, measured on the outside. The same section bars gaps or footholds that let a small child get under, through or over it. The barrier has to ring the pool itself and has to be separate from a yard fence, unless that yard fence runs along the pool and meets the same rules. Gates swing away from the pool and latch on their own.

Winter Haven law has no rule about this. The chapters that were read are listed below. Cities and counties decide it instead.
Florida has no spite fence law. The fence chapter sets no height that sets anything off and no rule about why a fence went up. Chapter 823, the public nuisance chapter, runs from bonfires to abandoned boats and never reaches a fence built to annoy a neighbor. A claim in Florida rests on common law nuisance instead, which is judge made rather than written by the legislature.

How fence height is measured in Winter Haven
Compare how height is measured across all 50 states
Winter Haven answers this in its own law. The words that do it are quoted below.
Winter Haven handles raised ground by regulating the berm itself rather than folding it into the fence height. A berm may not pass five feet, anything over two feet has to stay outside the visibility triangle, the slope may not exceed twenty five percent, and the whole thing is planted with grass or ground cover for stability. A continuous berm longer than two hundred and fifty feet has to be interrupted every two hundred and fifty feet by twenty five feet of landscaping, wall or fence, and no berm may reach into a right of way or sit over underground utilities.
Berms shall not exceed five (5) feet in height. Berms over two (2) feet in height are required to remain outside of any visibility triangle as defined by section 21-126.

- set in state lawFlorida answers the measuring question outright in its oldest fence section. A general fence stands at least five feet and keeps its gaps under four inches for the first two feet up from the ground. Where the fence is built with a trench beside it, those five feet run from the bottom of the ditch to the top of the fence. A bottom point and a top point, both named, which is the part most state fence rules leave out. The rule is about holding livestock. A yard fence in a Florida city is sized by local land development rules adopted under section 163.3202, and those rules carry their own way of measuring. Fla. Stat. 588.01Florida · Statute
Fence rules for corner lots in Winter Haven

Florida answers this in its own law. The words that do it are quoted below.
Florida has a state rule about blocking a driver from seeing what is coming, and it is written about signs. Chapter 479 bans a sign on the inside of a curve, or placed any way that could keep road users from seeing approaching vehicles, next to a state highway or a federal aid primary road. Section 337.406 adds that using a state road right of way in a way that gets in the way of traffic is unlawful. Neither one draws a triangle on a corner lot. That is left to local land development rules.

Winter Haven exempts a retaining wall from the height table but not from the rest of the section. It has to sit at least five feet back from the property line, it has to be maintained to its original designed condition like any other wall, and repairing one requires a building permit. - set in state lawFlorida statute names a wall that holds back earth in one place, and it is about how many permits a town can charge for. When one wall runs across more than one lot, the local government has to issue a single permit for the whole job and cannot demand one for each lot the wall crosses. The rule is written for houses, duplexes and townhouses. It sets no height and it does not say how the wall has to be built. Fla. Stat. 553.79(1)(i)Florida · Statute
- left to the townThe height at which a wall that holds back earth needs a permit is not in Florida statute. It is in the Florida Building Code, which the Florida Building Commission rewrites every three years from the newest International Building Code and International Residential Code. Fence materials allowed in Winter Haven
Compare materials across all 50 states
Winter Haven answers this, but the answer changes depending on the district and what the fence is for.
A Winter Haven fence has to be built of new materials made for the purpose, or of materials aged for proper architectural effect, which rules out salvage that simply looks old. The finished side faces outward toward the neighbor. Nothing designed or reasonably likely to injure a person or animal is allowed, razor and barbed wire, glass and electrically charged wire named among them, outside the C-4, I-1 and I-2 districts, where three strands of barbed wire may sit on top of a six foot fence, and the agricultural district, where barbed wire is allowed. A subdivision screening wall is brick, stucco, split face block, wrought iron, wood, stone or vinyl, finished in a warm earth tone, in a design residential in character and in keeping with established Central Florida architecture.
Fences must be constructed of new materials designed for that purpose or aged for proper architectural effect.
The answer turns on the district and what the fence is for.
- any district other than C-4, I-1, I-2 and AG
- Nothing likely to injure, and no razor or barbed wire.
- the C-4, I-1 and I-2 districts
- Three strands of barbed wire on top of a six foot fence. 3 strands

What this page does not cover
A city ordinance is not the only rule that reaches a fence. The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone. A homeowner association can be stricter than the city and nothing in the municipal code will say so. None of those appear here.
The rules above are the ones Winter Haven publishes, plus the Florida rules that apply where the city sets none. Fence laws in Florida has the state layer in full.
