A single or two family lot in the RS-5, RS-7 and RM-10 districts of Deerfield Beach may have no wall or fence in the required front yard at all, only a hedge of up to four feet. In the street side corner yard a fence may reach six feet but has to sit ten feet back from the property line, and a hedge may be eight. Side and rear lines take a six foot fence and an eight foot hedge. Multifamily land is held to six feet everywhere, with a five foot planting setback in the front and corner yards. Non-residential land gets eight feet on the same five foot setback. A waterfront yard allows an open fence, one less than seventy five percent obstructed, at six feet and a hedge at four.

Where a non-residential use abuts, or sits within twenty five feet of, residential zoning or a residentially developed site, a solid concrete block wall of six to eight feet is required, wholly inside the non-residential lot, with equal architectural treatment on both sides, painted stucco finished like the main building. Timing is fixed too: the wall goes up before or at the same time as the exterior walls of the first building, or earlier if the planning director decides the neighbors need protecting from dirt, dust, debris or noise.

Florida has no spite fence law. The fence chapter sets no height that sets anything off and no rule about why a fence went up. Chapter 823, the public nuisance chapter, runs from bonfires to abandoned boats and never reaches a fence built to annoy a neighbor. A claim in Florida rests on common law nuisance instead, which is judge made rather than written by the legislature.

Deerfield Beach answers this in its own law. The words that do it are quoted below.

Deerfield Beach builds the neighbor into the measurement. Height is the vertical distance from the average of the natural contours of the adjoining lot and the subject lot up to the highest point of the fence line, so neither owner can move the answer by regrading alone. The word natural also rules out reading from fill. On a masonry wall the measurement expressly takes in the column and its cap, which most codes exclude as decoration.

Height is to be measured in the following manner: the vertical distance from the average of the natural contours of the adjoining and subject lot to the highest point of the fence line. In the case of a masonry wall, measurement is to include the column and cap.

Deerfield Beach closes its residential materials list with a sentence that leaves no room, saying no other material is allowed. What is allowed is a block wall finished to professional quality on every exterior face, in stucco, prefinished block, stacked block with struck joints, shadow block or paint, and a fence of wood, PVC, chain link or metal picket with the finished side facing out. No wire thinner than twelve gauge may be used. On non-residential land two feet of barbed wire may sit on a fence of at least six feet, but only on a construction site with a live permit, on a utility site, at an essential public service, or in the B-3, I and PID districts where the owner has shown the city manager that the risk is substantially greater without it.

Fences of wood, PVC, chain-link or metal pickets shall be constructed with the finished side toward the outside of the property. No wire of less than 12-gauge shall be permitted. Other materials shall not be allowed.

What this page does not cover

A city ordinance is not the only rule that reaches a fence. The zoning district a parcel sits in can change the height allowed on it, and so can an overlay district, a recorded easement, a fire hazard severity zone or a coastal zone. A homeowner association can be stricter than the city and nothing in the municipal code will say so. None of those appear here.
